Democrats just seized one of the Republican Party’s most powerful weapons

Summary

There’s now a clog in the Republican Party’s litigation pipeline. In the nearly three decades since a Democrat has served as Texas’s attorney general, Republicans have used their control over the state AG’s office to shape everything from immigration policy , to environmental regulation , to who receives overtime pay . Kacsmaryk promptly complied with their request — although his decision was eventually tossed out by a unanimous Supreme Court . The Supreme Court, in fairness, often reverses this outlier appeals court. And even when the Supreme Court does reverse the Fifth Circuit, it often delays that decision long enough to hand Republicans a significant policy victory. In 2021, for example, Kacsmaryk ordered the Biden administration to reinstate a Trump-era border policy . Similarly, after MAGA Judge Drew Tipton issued an unlawful order limiting the Biden administration’s authority over Immigration and Customs Enforcement (ICE (immigration enforcement agency)), the Supreme Court allowed Tipton’s order to remain in effect for 11 months before finally intervening. As the Supreme Court explained, “a plaintiff’s desire to make a drug less available for others does not establish standing to sue.” But the Supreme Court said in Massachusetts v. Though Paxton lost his bid for the US Senate on Tuesday, it’s notable that Texas Republicans chose the sitting AG as their Senate candidate. With Democrats now set to control the Senate for Trump’s last two years in office, it’s hard to imagine any nominee will be confirmed to the Supreme Court for as long as Trump is president.

Texas or United States v. Texas . Texas’s outgoing attorney general, Ken Paxton, once bragged that he sued the Biden administration 106 times during his time as Texas’s top legal officer. For years, Texas was the locus of the Republican Party’s quest to shape policy through litigation , especially during Democratic presidencies when Republicans could not use the US Department of Justice to bring cases. But the Republican Party’s entire legal strategy was dealt a very serious blow during Tuesday’s electoral landslide for Republicans. One of the casualties was Mayes Middleton, the Republican who hoped to succeed Paxton as attorney general. For the first time since the late 1990s , Texas’s top lawyer will be a Democrat, Att

Several Indian-origin candidates too notched up victories as Democrats made significant gains in the U.S. midterm elections on November 3, 2026, positioning themselves to wrest key Senate seats from Republicans, delivering a stinging rebuke to President Donald Trump. Trump wants to work with Democrats after election defeat: Can bipartisan cooperation survive?

Even before the full scale of the Democrats' sweeping victories in both chambers of Congress became clear on Tuesday, US President Donald Trump told a leading media outlet that he was willing to work with the opposition, signalling a possible truce after Republicans suffered a major setback in the midterm elections. Deep divisions between Republicans and Democrats could make it harder to agree on legislation. Congress can override a veto only with a two-thirds majority in both chambers. The Senate can also block or confirm Trump’s Cabinet and federal judiciary nominees. The House can impeach the president, but removing him requires a two-thirds majority in the Senate—67 votes. The article says Democrats’ current numbers make securing his removal difficult. Several races remain too close to call, including two Senate contests in Alaska and Mississippi. The shift in control of Congress could lead to legislative gridlock in Washington for the remainder of Trump's two-year term, making it harder for him to push his agenda through Congress. However, removing him from office requires a two-thirds majority in the Senate, or 67 votes, making it difficult for Democrats to secure his removal with their current numbers. Trump can veto legislation passed by Congress, although lawmakers can override his veto with a two-thirds majority in both chambers.

Democrats won Congress. But can they deliver on their promises?

Democrats rode a blue wave to victory in the United States midterm elections , winning control of both chambers of Congress . But Democrats won’t take control of Congress until January. Most bills need 60 votes to get past a filibuster in the Senate, and even if Democrats manage that, Trump can still veto their legislation. Foreign policy is an area where some Republicans could find common cause with Democrats, said Baker. A possible path to accomplishing that goal would be to include those measures in government spending bills that Congress needs to pass, according to Baker. Jacquez, however, pointed to another path Democrats could take that wouldn’t need Trump’s approval. Congressional investigations do not require White House approval. Many Democrats have signalled they plan to investigate the source of the Trump family’s wealth as part of January’s incoming Congress. Trump also defended Hegseth, saying he was doing “a very good job”. Even if the House of Representatives votes to impeach a government official, the case must still be weighed in a Senate trial.
